Website and Resident Portal Terms & Conditions

Journal Student Living Pty Ltd (ACN 615 183 474) and its associated entities (together Journal, we, us, and our) maintains the resident portal (Resident Portal) and associated website available, available at www.journalstudentliving.com.au  (collectively Website) for your information and convenience.

Please read the terms and conditions of this Website (Terms) carefully, especially the content and completeness, and limitation of liability sections, as any use of the Website by you constitutes acceptance of the Terms.

To the extent permitted by law, we may change these Terms at any time.  We will notify you of these changes next time you log in to the Resident Portal.  In the case of any breach of these Terms, we reserve the right to seek all remedies available at law or in equity.

1     Resident Portal Account

Only residents booked to occupy our property are eligible to use the Resident Portal.

If you are eligible, you may register and create an account on the Resident Portal (Resident Account) by following the online registration process.  To use any features of the Resident Portal, you must have a Resident Account.

As part of the Resident Account registration process, we will ask you to provide or confirm information such as your name, contact details and identity verification.  You warrant that all information (including any personal information) that you provide at the registration stage is true, complete and accurate.

You may also have the option to provide other information about you to the Resident Portal (such as payment method information).  Such information will be recorded by the Resident Portal.

You are responsible for ensuring that the information stored on the Resident Portal is up to date.

We may refuse to create a Resident Account or suspend or cancel your Resident Account, if we, on reasonable grounds, suspect that any information that you provide is not correct, that you are not eligible to use the Resident Portal, you have misused the Resident Portal or otherwise committed a material breach of these Terms.  We may also cancel or suspend your Resident Account after you are no longer a resident of our property.

Your access to the Resident Portal is subject to a logon system linked to your Resident Account (when your account is first registered).  You must keep safe and secure all security credentials (such as username and password) associated with your Resident Account (Security Credentials), and you must not disclose them to anyone else or allow anyone else to use your Resident Account.  You are entirely responsible for any access to or use of the Resident Portal through your Resident Account, and you acknowledge and agree that any access to or use of the Resident Portal by means of the Security Credentials associated with your Resident Account is deemed to be access or use by you (other than any unauthorised use by our own staff).

You accept liability for loss or damage that we incur or suffer as a result of any misuse of your Resident Account or the Resident Portal by using your Security Credentials.

2     Use of Website and Resident Portal

You are responsible for all of your activity in connection with accessing and using the Website.

You must not use the Website for any activities that are unlawful, infringe any party’s rights or breach any mandatory standards, content requirements or codes.  You must not distribute through the Website any inappropriate communication or any virus or other disabling code in any form.

You must not bypass any security mechanisms imposed by the Website, or tamper with, hinder the operation of or make unauthorised access or modifications to the Website or its content.

3     Resident Portal Functionality

The Resident Portal will include such functionalities and features as determined by us from time to time.  We may make changes to the Resident Portal, including by disabling existing features, without prior notice to you, but if you have an active Resident Account, we will not disable any features of the Resident Portal without offering a replacement if this will result in you not being able to manage your booking or legal relationship with us.

We may from time to time carry out regular or emergency maintenance of the Resident Portal which may impact on the availability or your use of the Resident Portal.

Without limiting any other provisions of these Terms, we may discontinue providing the Website and the Resident Portal at any time by posting a notice on the Website or the Resident Portal at least 1 month before the date of discontinuation, but if we  elect to discontinue the Resident Portal and you have an active Resident Account, then we will provide you with a reasonable alternative means to manage your booking or legal relationship with us.

4     Privacy Collection Statement

We may collect your personal information through the Website and through the Resident Portal.  We collect, use, hold and disclose your personal information so that we can perform our business activities and to administer the Website and the Resident Portal.  We respect your right to privacy, and subject to any agreement that you have with us, you may elect not to provide your personal information to us.  However, if you choose not to do so, then we may not be able to respond to you, contact you or provide you access to the Resident Portal, or certain aspects of the Website may not function properly.  You cannot register for a Resident Account without providing your personal information as we need to verify the identity of the residence on our property.

As part of using your personal information, we may disclose your personal information to: (i) our employees, related bodies corporate, contractors, suppliers or service providers (such as service providers maintaining and operating the Website or our customer representatives to answer your queries); (ii) regulators and law enforcement agencies; (iii) (where you have agreed to receive direct marketing materials) associated businesses that may want to market services and products to you; and (iv) other organisations where you have consented.

Our privacy policy, available at www.journalstudentliving.com.au/terms-conditions/, contains information about how you may access and correct the personal information that we hold about you and how to lodge a complaint relating to our treatment of your personal information, and how we will deal with such complaint.

You consent to your personal information being collected, used and disclosed in accordance with these Terms and our privacy policy.  You must not provide the personal information of another person to us, unless that person has read, understood and accepted these Terms and our privacy policy.

5     Security

Information sent by you to us through the Website may not be encrypted and is transmitted at your own risk.  You acknowledge that we do not guarantee the security of the content of any such information, and it is entirely your responsibility to satisfy yourself as to whether our security measures are sufficient for your requirements.

If you send us information by e-mail, we will regard this as your consent to our communicating with you about the matter in question by e-mail. Should an e-mail which was demonstrably sent by Journal not reach its intended recipient by accident, Journal assumes no liability whatsoever for any disadvantageous consequences which arise as a result.

To the extent permitted by law, Journal shall have no liability or any responsibility whatsoever for any loss suffered caused (whether negligently or otherwise) by viruses that may infect your computer equipment or other property by reason of your use of, access to or downloading of any material from the Website. If you choose to download material from the Website you do so at your own risk.

6     Content and Completeness

We will use reasonable endeavours to maintain and update the content of  the Website regularly to ensure they are current and accurate. Despite this, we make no warranty or representation that the information on the Website is accurate, complete, reliable or current. Any reliance upon the material on this website shall be at your own risk.

Any information on the Website is subject to change without notice.

We do not warrant that access to the Website or any parts of it will be uninterrupted, or that the services and features offered on the Website will be error-free or available when required.  Subject to clause 3 in relation to the Resident Portal, we reserve the right to, from time to time, change or discontinue any feature on the Website and the browser software required to access it.

7     Intellectual Property Rights

All copyright and other intellectual property rights in all information, data, text, graphics, images, logos, trademarks, sound recordings, videos and other materials on the Website are the property of Journal or its licensors.  We authorise you on a non-exclusive basis to reproduce and download the materials solely for use in the intended manner.  Otherwise, to the extent allowed by law, no part of the Website or its content may be reproduced, reused, retransmitted, adapted, published, broadcast or distributed without our prior written permission.

All names, logos and trade marks on the Website are the property of their respective owners.  Nothing on the Website should be interpreted as granting any rights to commercial use or distribution of any names, logos or trademarks, without the express written agreement of the relevant owners.

This clause survives termination of these Terms.

8     Liability

To the maximum extent permitted by law, we exclude all warranties, guarantees, terms and conditions (whether express, implied or statutory) relating in any way to the Website, its content or use.  Our liability for breach of any warranty, guarantee, term or condition implied into these Terms which cannot be excluded is limited, where permitted by law, to the re-supply of that part of the Website again or, at our option, the payment of the costs of having an equivalent service supplied again.

To the maximum extent permitted by law, we exclude all liability for any consequential loss or indirect loss, loss of data or loss of profits, loss of profit, loss of reputation or loss of business arising in relation to the Website or its content (including any inability to use any part or features of the Website), whether or not it is caused by our negligence, and whether or not the possibility of loss was known to us.

Subject to any laws the application of which may not be lawfully excluded, our aggregate liability to you on any basis and in any circumstances (including liability for negligence) arising out of or in connection with these Terms, the Website or its content (including any inability to use any part or features of the Website), will not exceed, and is expressly limited to: (1) AUD$5,000 if you have a Resident Account; and (2) AUD$1 if you do not.

This clause survives termination of these Terms.

9     Links to Other Websites

Links on the Website may take you outside the Journal network to third party websites and Journal makes no representations and accepts no responsibility for the content, accuracy or function of these other websites. The inclusion of any link to other websites does not imply endorsement by Journal.

If the Website contains third party advertisements (such as banner ads or referral buttons) which contain embedded links to other sites where goods or services are advertised, the placement of such advertisements on the Website does not constitute the recommendation or endorsement by us or any goods or services advertised by the third party. The third party advertiser is solely responsible to you for any representations or offers made by it, and for any goods or services which you agree to purchase or acquire from those third parties.

10     Prohibited Activity

You are prohibited from doing, on the Website, any act that Journal, in its reasonable discretion, may deem to be inappropriate and/or would be deemed to be an unlawful act including but not limited to:

  • Any act that would constitute a breach of either the privacy (including uploading private information without the concerned individual’s consent) or any other of the legal rights of individuals;
  • Using the Website to defame or libel Journal, its employees or other individuals or acting in such a way that brings into disrepute the good name of Journal; and
  • Uploading files that contain viruses that may cause damage to the property of Journal or the property of other individuals.

11     Termination

We reserve the right to restrict or terminate your access to this Website or any feature of this Website at any time, but we will act reasonably in doing so. Any termination of your right to use or access any part of the Website will not affect any rights which have accrued to or have been accrued by either you or us prior to termination, and the last paragraph of clause 3 will apply if we elect to discontinue the Resident Portal.

12     Updates 

We reserve the right to make any changes and corrections to these Terms. Please refer to this page from time to time to review these and new additional information.  If you have an active Resident Account, changes to these Terms that have a material and adverse impact on you will not apply unless and until: (1) you accept the changes; or (2) your Resident Account is cancelled or suspended.

13     Severance

If any provision of these Terms is held void, unenforceable or illegal, that provision or the relevant part of that provision will be severed, and the rest of these Terms will have full force and effect.

14     Jurisdiction

You and Journal agree that any claim arising from or pertaining to the use of this website shall be governed by the laws in the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.

Privacy Policy

1     Introduction

This Policy applies to Journal Student Living Pty Ltd (ACN: 615 183 474) and its associated entities (referred to as ‘Journal’, ‘we’, ‘our’, ‘us’).

This privacy policy (‘Policy’) outlines how we collect and  manage your personal information. We respect your right to privacy under the Privacy Act 1988 (Cth) (‘Privacy Act’) and Australian Privacy Principles (‘APPs’) and this Policy outlines how we comply with all of the Privacy Act and APPs requirements in respect of the collection, management and disclosure of your personal information.

In this Policy:

  • disclose’ in relation to information means providing information to persons outside Journal;
  • Individual’ means any persons whose personal information we collect, use or disclose;
  • personal information’ has the meaning given to it in the Privacy Act. In general terms it is information or an opinion about an identified individual, or an individual that is reasonably identifiable;
  • Privacy Officer’ means the contact person within Journal from time to time for questions or complaints regarding Journal’s handling of personal information;
  • sensitive information’ has the meaning given to it in the Privacy Act. This includes personal information relating to a person’s racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, membership of a trade union or other professional or trade association, sexual preferences or practices, criminal record, health information or genetic information that is not otherwise health information; and
  • use’ in relation to information means use of information within Journal.

2     What kind of personal information do we collect and hold?

We may collect and hold the following kinds of personal information about you, including:

  • name;
  • address;
  • phone numbers;
  • email addresses;
  • bank account details;
  • age or date of birth;
  • drivers’ licence, passport or other identification details;
  • nationality or country of origin;
  • enrolment and attendance details at an educational institution;
  • emergency contact details;
  • any additional information relating to you that you provide to us directly through our websites or indirectly through use of our websites or online presence, through our representatives or otherwise; and
  • any other information that is relevant to the services that we provide.

3     How we collect personal information

We generally collect your personal information by the following methods:

  • through your access and use of our website (www.journalstudentliving.com.au) – please refer to our Website Terms and Conditions for further information;
  • directly from applications, questionnaires and other forms you complete when you wish to use our services or accommodation;
  • from information disclosed to us by you on the phone, or by sending us correspondence (including letters and emails) or visiting us in person; and
  • from a variety of third-party sources such as law enforcement agencies and other government entities.

The above list is not exhaustive.

When we are provided with personal information from a third party, we will take reasonable steps to ensure that you are or have been made aware of the matters set out in this Privacy Policy.

Journal will not collect sensitive information unless you have consented to the collection or an exemption under the APPs applies. These exceptions include if the collection is required or authorised by law or necessary to take appropriate action in relation to suspected unlawful activity or serious misconduct.

If the personal information we request from you is not provided, some or all of the following may happen:

  • we may not be able to provide you with the benefit of our services or accommodation, or meet your needs appropriately;
  • we may not be able to provide you with information about products or services that you may want, including information about discounts or special promotions; or
  • certain functionalities of our website may not be accessible or functional.

Journal does not give individuals the option of dealing with them anonymously, or under a pseudonym. This is because it is impractical, and in some circumstances illegal, for Journal to deal with individuals who are not identified.

4     Who do we collect personal information about?

The personal information we may collect and hold includes (but is not limited to) personal information about:

  • customers;
  • potential customers;
  • service providers or suppliers;
  • prospective employees, employees and contractors; and
  • other third parties with whom we come into contact

5     Why does Journal collect,  hold, use and disclose personal information?

We collect personal information about you so that we can perform our business activities and functions and to provide the best possible quality of customer service.

We may collect, hold, use and disclose your personal information  for the following purposes:

  • to conduct our business of providing student accommodation and associated services;
  • to assist with completion of documentation and forms in relation to our accommodation and other products and services;
  • to consider and assess your request for accommodation and other products or services;
  • to provide you with information about marketing and other promotional offers, activities or events;
  • to protect our business from fraudulent or unlawful activity;
  • to conduct our business and perform other management and administration tasks;
  • to consider and respond to any enquiries, concerns or complaints you may have;
  • to manage any legal actions involving Journal;
  • to comply with relevant laws, regulations and other legal obligations;
  • to help us improve the products and services offered to our customers and to enhance our overall business;
  • to update our records and keep your contact details up to date (and to inform our related bodies corporate, contractors or service providers of the updated contact details); and
  • to comply with any law, rule, regulation, lawful and binding determination, decision or direction of a regulator, or in co-operation with any governmental authority of any country.

We engage other people to perform services for us, which may involve that person handling personal information we hold. In these situations, we require such person not to use personal information about you except for the specific purpose for which we supply it. We require such person not to use your information for the purposes of direct marketing their products or services.

When we no longer need your personal information, and we are not required by law to retain the information, we will take reasonable steps to delete or de-identify it.

6     Who might we disclose personal information to?

We may disclose your personal information to:

  • our employees;
  • a related entity or affiliate of Journal;
  • an agent, contractor or service provider we engage to carry out our functions and activities, such as our lawyers, accountants, debt collectors or other advisors;
  • organisations involved in a transfer or sale of all or part of our assets or business;
  • organisations involved in managing payments, including payment merchants and other financial institutions such as banks;
  • educational institutions for their internal records;
  • regulatory bodies, government agencies, law enforcement bodies and courts; and
  • anyone else to whom the individual authorises us to disclose it or is required by law.

We may also collect personal information from these organisations and individuals and will deal with that information in accordance with this Policy.

7     Sending information overseas

We may disclose personal information to affiliates of the Journal group or cloud servers hosting Journal websites or IT infrastructure that are located outside of Australia. These recipients may be located in the following country:

  • United States of America

We will not send personal information to recipients outside of Australia unless:

  • we have taken reasonable steps to ensure that the recipient does not breach the Act and the APPs;
  • the recipient is subject to an information privacy scheme similar to the Privacy Act; or
  • the individual has consented to the disclosure.

8     Management of Personal Information

Journal recognises how important the security of personal information is to our customers. We will at all times to reasonable steps to ensure that the personal information we collect and hold is protected from inference, misuse or loss, and unauthorised access, modification or disclosure. Journal employees must respect the confidentiality of the personal information we collect.

All paper files are stored in secure areas. Personal information is generally held in a computer database. In relation to our computer-based information, we apply the following guidelines:

  • data ownership is clearly defined within Journal;
  • passwords are routinely changed
  • we change employees’ system access when they are assigned to a new position that no longer requires such access;
  • employees have restricted access to certain sections of the system;
  • the system automatically logs and reviews all unauthorised access attempts;
  • unauthorised employees are barred from updating and editing personal information;
  • all personal computers which contain personal information are secured, physically and electronically;
  • data is encrypted during transmission over the network;
  • print reporting of data containing personal information is limited;
  • Journal has created procedures for the disposal of personal information; and
  • personal information is overwritten to the extent possible when the information is no longer required.

9     Direct Marketing

Journal does not use personal information for the purposes of direct marketing, unless:

  • the personal information does not include sensitive information;
  • you would reasonably expect us to use or disclose the information for the purpose of direct marketing, or you have consented to the use or disclosure of the information for direct marketing;
  • we provide a simple way of opting out of direct marketing; and
  • you have not requested to opt out of receiving direct marketing from us.

In relation to sensitive information, Journal will only use or disclose your sensitive information for the purpose of direct marketing if you have consented to the use or disclosure of the sensitive information for that purpose.

At any time, you may opt out of receiving marketing communications from us by contacting us (see the details below) or by using opt out facilities provided in the marketing communications and we will then ensure that you are removed from our mailing list.

You may also request that Journal provides them with the source of your information. If such a request is made, Journal must notify you of the source of the information free of charge within a reasonable period of time.

10     Identifiers

We will not use identifiers assigned by the Government, such as a tax file number, Medicare number or provider number, for our own file recording purposes, unless one of the exemptions in the Privacy Act applies. Journal endeavours to avoid data-matching, being the comparison of data collected and held for two or more separate purposes in order to identify common features in relation to individuals, as a basis for further investigation or action in relation to those individuals.

11     How do we keep personal information accurate and up-to-date?

Journal is committed to ensuring that the personal information it collects, holds, uses and discloses is relevant, accurate, complete and up-to-date.

We encourage you to contact us to update or correct any personal information we hold about you. If we correct information that has previously been disclosed to another entity, we will notify the other entity within a reasonable period of the correction. Where we are satisfied information is inaccurate, we will take reasonable steps to correct the information within 30 days, unless you agree otherwise.

12     Access to personal information

You may request access to any personal information we hold about you at any time by contacting us (see the details below).  Where we hold information that you are entitled to access, we will try to provide you with suitable means of accessing it (for example, by mailing or emailing it to you). We will endeavour to provide access within 30 days of your request.

There may be instances where we cannot grant you access to the personal information we hold.  For example, we may need to refuse access if granting access would interfere with the privacy of others or if it would result in a breach of confidentiality. If we refuse to provide the information, we will provide reasons for the refusal.

We will require identity verification and specification of what information is required. An administrative fee for search and photocopying costs may be charged for providing access.  We will not charge for simply making the request and will not charge for making any corrections to your personal information.

13     Incidents, enquiries and complaint handling

If you have any questions about our privacy procedures or if you wish to make a complaint about how we have dealt with your personal information, or if you believe that your privacy has been breached, please contact our Privacy Officer (contact details below) and provide details of the incident so that we can investigate it.

Journal has an effective complaint handling process in place to manage privacy risks and issues.

The complaints handling process involves:

  • identifying (and addressing) any systemic/ongoing compliance problems;
  • increasing customer confidence in Journal’s privacy procedures; and
  • helping to build and preserve Journal’s reputation and business.

After we have completed our enquiries, we will contact you, usually in writing, to advise the outcome and invite a response to our conclusions about the complaint.  If we receive a response from you, we will assess it and advise if we have changed our view.

We will treat your requests or complaints confidentially.  Our representative will contact you within a reasonable time after receipt of your complaint to discuss your concerns and outline options regarding how they may be resolved. We will aim to ensure that your complaint is resolved in timely and appropriate manner.

15     What if I’m not satisfied with the response?

If you are not satisfied with the result of your complaint to Journal you can also refer your complaint to the Office of the Australian Information Commissioner.

Cancellation Policy

Cooling-Off Period:

If you have not entered into and/or commenced your tenancy agreement, you may cancel your booking without penalty within 48 hours of a booking. Any deposits or initial payments made will be refunded in full.

First-Year Student Cancellation Policy:

We understand that you may wish to book accommodation even though you have not received your Australian visa or your university offer, and our policies support these circumstances.

No Visa: If your visa application is denied by the Department of Home Affairs (“DHA”) you may cancel your booking without penalty, provided that with a minimum of 7 days written notice prior to the commencement of your tenancy agreement you; submit your Refund Request Form to Journal within 72 hours of receiving the DHA refusal decision, and provide a copy of the DHA refusal document.

No University Offer: If your university application is not accepted you may cancel your booking without penalty, provided that with a minimum of 7 days written notice prior to the commencement of your tenancy agreement you submit your Refund Request Form to Journal within 72 hours of receiving the university’s decision, and provide a copy of the non-acceptance letter.

Refer a Friend Offer

1. Offer Details

Refer a friend to live at Journal and earn $400 for each friend referred.

  • The referrer will receive a $400 cash card per referred friend who books a Full Year (12-month) lease and checks into their room.
  • A maximum of 2 referrals (i.e., up to $1600 in cash cards) can be made per referrer.
  • The referral period is from 1st April to 27th July 2025.

2. Definitions

2.1 Referrer is someone who has booked a full year (12-month booking), pay all associated fees and have signed a Residential Rental Agreement.

2.2 Referee is someone new to Journal who is not currently residing or has not previously resided at a Journal facility and/or does not have an existing booking for a Journal facility.

3. Eligibility Criteria

To qualify for this offer, the referrer and the referee must meet all the following conditions:

3.1 For Referrers to be eligible:

  • You must have booked a full year (12-month booking), paid all associated fees and have signed a Residential Rental Agreement at the time your referee’s booking.
  • You must complete the Refer a Friend form on the Journal website prior to commencement of your referee’s booking.
  • You must have the referee’s consent to disclose their personal details to Journal prior to submission of the form.
  • Your referee must complete a direct booking, pay all associated fees, sign a full year (12-month) Residential Rental Agreement with Journal, and check into their booking.
  • The booking of your referee must be made online via the Journal website (not valid for bookings made through agents, universities, or third-party platforms).
  • In cases where a referee is referred by more than one person, only the first submitted form will be eligible.
  • Maximum of 2 eligible referrals per Referrer will be accepted.

3.2 For Referees to be eligible:

  • You must be enrolled in a tertiary education program at the start of your lease.
  • You must complete a full year (12-month booking), pay all associated fees, sign a Residential Rental Agreement and check into your booking.
  • The booking must be made online via the Journal website (not valid for bookings made through agents, universities, or third-party platforms).

Additional Terms

  • The $400 cash card will be paid to the referrer after the referrer and the referee have checked into their booking.
  • It is the referrer’s responsibility to collect the cash card from Journal’s reception.
